Creditors' Rights Solutions

The Creditors’ Rights Practice Group provides traditional services such as litigation, collection on accounts and representation in the Bankruptcy Court, as well as proactive and preventative services, such as design of credit monitoring systems to reduce the likelihood of litigation, creation of security for transactions, and creation of protective language in existing client documents, doing so in a manner that is cognizant of the client’s bottom-line business needs.

Our Group includes the only attorney in the Mahoning Valley area to be certified by the American Board of Certification as a Specialist in Creditors’ Rights Law.

Areas of practice

Asset Protection

Our attorneys assist clients in structuring their assets and holdings to maximize opportunities for preserving them against exposure to creditors.

Bankruptcy

The firm represents secured and unsecured creditors, creditors’ committees and trustees in bankruptcy reorganizations, arrangements, liquidations and workouts. Our attorneys pursue defense of claims of preferential payment, the enforcement of secured and priority claims and conduct insolvency litigation in the United States Bankruptcy Court with a view toward maximizing the client’s return.

Collections

Our attorneys pursue both consumer and commercial collections on behalf of the firm’s clients, offering advantages over traditional debt collection agencies. Our attorneys explore options short of litigation that produce more efficient results on behalf of our clients while, at the same time, being ready to utilize all available legal procedures in pursuit of the client’s goals.

Commercial Litigation

Members of the Creditors’ Rights Practice Group litigate a variety of commercial issues in both State and Federal Courts, including breach of contract, lien enforcement and foreclosure, and commercial lease disputes.

Compliance

Day-to-day business activities are increasingly becoming subject to regulatory disclosures, particularly in dealing with consumer goods. The Creditors’ Rights Group assists in assuring that our clients have complied with all necessary disclosures for transactions.

Transactional Documentation

Recognizing that proper planning and preparation is the best avenue to avoid uncollected debt, our Practice Group members assist clients in designing documents to evidence their commercial relationships so as to best assure payment from the customer. These services range from assisting the client in preparing documents to properly record routine day-to-day transactions in the business to negotiating and designing major transactions, including sales and financing. In addition, our attorneys assist business clients in the design of their credit systems.
